Heard learned counsel for the petitioners, learned counsel for the informant as well as learned Addl. Public Prosecutor for the State.
Petitioners apprehend their arrest in connection with Saharsa Sadar P.S. Case No.500 of 2016 for the offences registered under sections 147, 149, 341, 323, 307, 406, 419, 420, 379, 354(B), 504 and 506 of the Indian Penal Code. The informant happens to be daughter of petitioner no.1
Patna High Court Cr.Misc. No.35897 of 2016 (3) dt.15-11-2016 2/2 and it is alleged that she had given Rs.34,00,000/- to petitioner no.1 on credit on different dates but subsequently, petitioner no.1 gave only Rs.11,00,000/- to the informant and rest amount was not paid to her and when she demanded her rest amount, all the petitioners assaulted and made attempt to outrage her modesty. The informant has filed counter affidavit in which Annexure-A has been annexed and in course of investigation, learned counsel appearing for the informant submits that some post dated cheques had been given to the informant by petitioner no.1 but the aforesaid cheques had never been presented before the concerned Bank.
Considering the facts and circumstances of the case as well as submissions of the parties, let petitioners above named, in the event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in Saharsa Sadar P.S. Case no. 500 of 2016 subject to condition as laid down under section 438(2) of the Cr.P.C.
