JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-09-2016 Heard learned counsels for the petitioner and the State. The petitioners being the agnates of the alleged husband of the complainant are apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A, 323 and 379 of the Indian Penal Code.

The basic accusation is of torture.

It is submitted by the learned counsel for the petitioners that in fact Vikash Kumar was abducted at the hand of the complainant on 14.12.2014 and forcibly married with the complainant Asha Devi. Subsequently, Vikash Kumar being minor

Patna High Court Cr.Misc. No.39114 of 2016 (2) dt.07-09-2016 2/2 was found on Nadwan station on 21.12.2014 leading to filing of Complaint Case No. 52C of 2015 against the complainant and her family.

Considering the fact that the petitioners are the agnates of the alleged husband of the complainant, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Masaurhi in connection with Complaint Case No. 01C of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
