The petitioner apprehends his arrest in connection with Mohania P.S. Case No.327 of 2015 for the offences punishable under sections 353 and 333 of the Indian Penal Code. Mr. Sheo Kumar Prasad, learned counsel appearing on behalf of the petitioner with reference to the FIR placed at Annexure-1 submits that a bare perusal thereof confirms that the allegations are concocted. He submits that the petitioner has his hotel near the check post and despite, neither the truck was impounded nor the SAP Jawan present there apprehended the petitioner nor the petitioner is charged with violation of the Arms Act.
Having heard learned counsel for the parties and considering the submissions of learned counsel and the materials on record let the petitioner, namely, Chhotelal Jaiswal in the event of his arrest or surrender within four weeks from today be

No.52954 of 2015 (2) dt.17-12-2015 released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Mohania P.S. Case No.327 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
