JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 2 18-02-2022 Heard the parties through video conferencing. The petitioner seeks bail in anticipation of his arrest in connection with Pauthu P.S. Case No. 34 of 2021 instituted for the offences under Sections 379, 411 and 34 of the Indian Penal Code. Learned counsel submits that the petitioner is the owner of the tractor which has been seized carrying sand. The driver was arrested and the petitioner is being sought to be arrested on the said count that he is the owner of the tractor.

I have considered the submissions.

Apparently offence under Sections 379, 411 and 34 of the Indian Penal Code would not be made out against the petitioner, in view thereof I am inclined to grant benefit of anticipatory bail to the petitioner and in the event of arrest he shall be released on bail subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code.
