====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 23-11-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offences punishable under Sections 30 (a), 30 (d) and 32 (3) of Bihar Excise Amendment Act.
It is contended that, as per allegation, 20 liters Jaggery and two liters country made liquor were recovered from the house of the petitioner. It is contended that the petitioner was not apprehended from the spot and, in fact, he has been named in the FIR on the basis of disclosure of co-accused Mukesh Kumar Ram, who has already been granted bail by a co-ordinate Bench of this Court vide order dated 24.04.2017 passed in Cr. Misc. No.14455/2017. It is urged that the petitioner is in custody since 29.08.2017 and, as such, he has completed about three months
Patna High Court Cr.Misc. No.54160 of 2017(2) dt.23-11-2017 2/2 in custody. It is claimed that his antecedent is clean. Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Patna in connection with 3rd Additional Sessions Judge-cum-Special Judge, Excise, Muzaffarpur in connection with C" 01/17 PR No.130/16-17 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
