The petitioner seeks bail in connection with Session Trial No. 162 of 2017 arising out of Munger Mufassil P.S. Case No. 141 of 2016 registered under Section 364/34 of the Indian Penal Code.
Husband of the informant is said to have land dispute with the accused Rajesh Kumar Singh @ Bunnu Singh and said accused had extended threatening and asked him to leave the land. One week later, the petitioner and accused Tuntun Mandal took her husband with them to purchase tractor taking Rs. 2,50,000/-. It is suspected that the petitioner along with aforesaid
Patna High Court Cr.Misc. No.51531 of 2017 (3) dt.21-12-2017 2/2 two accused persons hatching conspiracy committed murder of her husband.
It is submitted by learned counsel for the petitioner that the deceased had no animosity with the petitioner rather with Rajesh Kumar Singh over land dispute as Rajesh Kumar Singh had extended threatening and asked the deceased to leave the land. The petitioner is merely suspected to have eliminated the deceased in collusion of the said Rajesh Kumar Singh by taking him from his house for purchasing tractor along with other co-accused. There is no eye witness of the occurrence. None of the witnesses has witnessed the petitioner taking the deceased from his house. The petitioner has been languishing in custody since 28.11.2016. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Munger in connection with Session Trial No. 162 of 2017 arising out of Munger Mufassil P.S. Case No. 141 of 2016.
