02. 26.10.2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 467, 468, 471, 406, 409, 420 and 120(B)/34 of the Indian Penal Code. It is contended on behalf of the petitioner that he is Panchayat Technical Assistant and the records are not kept in his possession. Actually, the Panchayat Rojgar Sevak is the custodian of records. It is further contended that the Assistant Engineer who is responsible for the works of MANREGA has been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 06.10.2016 rendered in Cr. Misc. No. 38083 of 2016, a copy of which has been produced at the time of hearing. Let it be kept on record.

No.43438 of 2016 (2) dt.26-10-2016 Having regard to the facts and circumstances of the case, let the petitioner, namely, Sanjeev Kumar be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Mahua P.S. Case No. 263/2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
