JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Chandi (Wena) P.S. Case No.271 of 2017 registered under Sections 147, 149, 341, 323, 307, 379, 354 A ad 504 of the Indian Penal Code. As per the prosecution case, the petitioner along with seven other accused persons are said to have assaulted on the head of son of the informant, namely, Munna Kumar by means of lathi inflicting bleeding head injury to him. They also misbehaved with the wife of the Munna Kumar and assaulted his family members.

It is submitted by learned counsel for the petitioner that the allegation against the petitioner is not specific rather general and omnibus in nature. The doctor has found only one

Patna High Court Cr.Misc. No.50268 of 2017 (02) dt.17-10-2017 2/ 2 injury on the head of the injured. Hence, the author of said injury is not ascertained. The petitioner has been languishing in custody since 20.08.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Chandi (Wena) P.S. Case No.271/2017.
