25-02-2020 Heard learned counsel for the parties.

The petitioner apprehends his arrest in Bihra (Saharsa) P.S. Case No. 75 of 2015 registered for the offence under Sections 406, 420, 409 of the Indian Penal Code. In the F.I.R., it is alleged that petitioner, being a government official, has misappropriated huge amount of public money in connivance with other accused persons by preparing forged and fabricated bills. It is further alleged that petitioner, being incharge of Purchase Centre, Salkhua for purchasing paddy from different cultivators, had transported paddy from a truck, bearing no. BR50D-0132, but on enquiry, it was found

Patna High Court CR. MISC. No.47600 of 2019(5) dt.25-02-2020 2/2 that above registration number of vehicle was of a motorcycle and as such, involvement of petitioner surfaced in misappropriation of public money.

It was submitted by learned counsel for opposite party no. 2 that the bail application has been filed by the petitioner after laps of four years and petitioner has also criminal antecedent of similar nature, which fact has been stated in paragraph - 3 of the petition.

In view of specific allegation against the petitioner as well as criminal antecedent, I am not inclined to extend the privilege of bail.

The prayer for bail stands rejected.

The interim protection granted by this Court, vide order dated 31-07-2019, stands vacated.
