Mr.Sri Ataur Rahman ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-01-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody in connection with Sadar (Hajipur) P.S. Case No. 375 of 2018 (Spl. Case No. 15/18) registered for the offence punishable under Section 7 and 13 (A) (D) of Prevention of Corruption Act, 1988.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that at the relevant time he was posted at Hajipur as Assistant SubInspector of police. Allegation against this petitioner is that he has demanded Rs.25,000/- in order to hush up the case. Learned counsel for the petitioner would submit that after three days of the alleged occurrence rupees twenty thousand was recovered

Patna High Court Cr.Misc. No.65831 of 2018(5) dt.25-01-2019 2/2 from the house of the petitioner, this is the only materiel against this petitioner to implement the petitioner in the instant case. Having regard to the fact that the petitioner was at the relevant time posted as Assistant Sub-Inspector of police and after three days of alleged incident of the demand of bribe Rs. 20,000/- was recovered from the house of the petitioner and the petitioner is in custody since 15.6.2018, the Court is inclined to enlarge the petitioner on bail, let the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Special Court of vigilance, North Bihar, Muzaffarpur in connection with Special Case No. 15 of 2018.
