JUSTICE PURNENDU SINGH ORAL ORDER 04-10-2024 The petitioner in paragraph no. 1 of the present writ petition has sought, inter alia, following relief(s), which is reproduced hereinafter:- "That this is an application for issuance of writ in the nature of writ of certiorari, mandamus or any other appropriate writ or writs, order or direction commanding the respondents to reinstate and regularise the services of the petitioner law-fully appointed by the competent appointment authority on the vacant and sanctioned Post of Health Educator by setting aside the ex parte order/Judgment dated 25.10.2010 passed by the Chairman, one man committee in a case No.

125/2010 (Annex-8) and the respondents be further directed to consider the case of the petitioner in terms and conditions, and criterions enumerated in the report contained in memo No.1117 (4) dated 20.9.2007 submitted by the 5 members committee of the Health Department, Government of Bihar before this Hon'ble Court in the light of and in compliance of the order/directions dated 26.6.2006 passed by Division Bench of this Hon'ble Court in L.P.A. No. 946/2003 and analogous cases (L.P.As and writ petitions) reported in 2006 (3) PLJR 386 and petitioner has been discriminated."

2. It appears from the pleadings made in the writ petition that the petitioner has sought for consideration of his grievance in compliance of the direction contained in order dated 26.06.2006 passed in L.P.A. No. 946 of 2003, reported in 2006 (3) PLJR 386.

3. Considering the aforesaid relief claimed in the present writ petition, the ex-parte decision dated 25.10.2010 passed by the Chairman, one man committee is set aside.

4. The petitioner, if so advised, may file a detailed representation before the competent authority for redressal of his grievance in accordance with law.

5. The writ application stands disposed of.
