Case No. 81

Patna High Court Cr. WJC No.1278 of 2015 dt.29-03-2016 2 / 2 of 2015 dated 08.04.2015 registered, inter alia, under Sections 420 and 407 of the Indian Penal Code.

I have heard learned counsel for the petitioner and learned counsel for the State and perused the allegations made in the first information report as contained in Annexure-1 to the present application. The allegations made therein do attract ingredients of a cognizable offence.

This court had an occasion to deal with several other similar applications for quashing of the FIRs having more or less identical allegations in the matter of Jai Mata Di Rice Mill & Ors. Vs. The State of Bihar and Ors. and analogous cases [(2015) 4 BBCJ 335].

In the matter of Jai Mata Di Rice Mills (supra), all the applications were dismissed vide reasoned order dated 05.10.2015. For the reasons recorded in the aforesaid order dated 05.10.2015, the application is dismissed.

However, the petitioner would be at liberty to agitate all the points available in law in case an adverse police report is submitted against him.
