1. Heard learned counsel for the petitioner and counsel appearing on behalf of the respondent.

2. Petitioner has filed present writ application for issuing direction to the respondents to consider the case of the petitioner for grant of promotion in terms of the ACP rules. Since the respondent have not taken decision on the claim of the petitioner for grant of ACP.

3. In view of the above, the writ petition is disposed of with direction to the respondent District Programme Officer (establishment) Saran at Chapra to take final decision on the claim of the petitioner for grant of promotion under the ACP rules.

4. This writ petition was filed on 10.11.2014 after service of two advance copies to the office of the Advocate General. Even after lapse of 4 years no counter affidavit was filed on behalf of the respondent.

5. Final decision on the claim of the petitioner for grant of promotion under the ACP rules may be taken by the District Programme Officer (establishment) Saran at Chapra within a maximum period of four months from the date of receipt/ production of a copy of this order.

6. With the aforesaid the writ petition stands disposed of.
