The petitioner seeks bail in anticipation of his arrest in connection with Tarari P. S. Case No. 67 of 2018, dated 04.06.2018, instituted for the offences under Sections 341, 323, 307, 354, 325, 448, 504, 379, 506 and 147 of the Indian Penal Code.

The accusation against the petitioner and others is of assaulting the members of the prosecution party including the husband of the informant.

No.40125 of 2020(5) dt.02-08-2021 2/3 The learned counsel for the petitioner has submitted that though he has been named in the F.I.R., but there is no specific accusation against him. There is a counter version of the occurrence also lodged by one Shila Devi against the husband of the informant and others vide Tarari P. S. Case No. 68 of 2018. The learned counsel for the petitioner has submitted that there was a slugfest between the parties and both sides have filed cases against each other. The injuries suffered by the victim of this case is stated to be simple in nature.

The petitioner and the informant are co-villager and are known to each other.

Regard being had to the nature of accusation and the background facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail

No.40125 of 2020(5) dt.02-08-2021 3/3 bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Bhojpur at Ara, in connection with Tarari P. S. Case No. 67 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.

The application stands allowed.
