JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.
The prosecution case is that the informant sold paddy worth rupees four lacs on credit to the petitioner and others who are the proprietors of Bhagwan Agro Private Limited when the informant went to demand his due amount then the petitioner smashed the receipt.
It is submitted by the learned counsel for the petitioner that there is no proof with regard to supply of paddy to the petitioner and others and similarly situated co accused has been
Patna High Court Cr.Misc. No.55376 of 2015 (2) dt.07-12-2015 2/2 granted anticipatory bail vide Cr. Misc. No. 50628 of 2015. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Rohtas, Sasaram in connection with Nokha P.S. Case No.167 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
