JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 28-07-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 376 of the Indian Penal Code.

It is a case of committing rape by this petitioner. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner has no criminal antecedent. Learned APP appearing for the State opposed the anticipatory bail and submitted that the informant asserted in her FIR that this petitioner committed rape forcefully on the alleged date and time of occurrence. The statement of the victim girl got recorded under Section 164 of the Cr.P.C. in which she also

Patna High Court CR. MISC. No.52860 of 2021(4) dt.28-07-2022 2/2 corroborates the prosecution case in respect of committing rape by this petitioner.

Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail is rejected.
