Heard learned counsel for the petitioner and counsel appearing on behalf of the State.

The present writ petition has been filed by the petitioner for a direction to the respondent to grant promotion as Headmaster and also grant pay scale of Headmaster from the date junior to the petitioners have been granted such promotion. 3.

Petitioner has not impleaded any junior and has not furnished any particulars to establish who were the junior and who have been granted such promotion Annexure '2' contains list of certain teachers but there is no specific pleading how those

Patna High Court CWJC No.12397 of 2014 (2) dt.12-09-2018 teachers are junior to the petitioner. Those teachers were granted such promotion pursuant to the order passed in different writ petition and as such the Court is not in a position to decide the claim of the petitioner that junior to the petitions have been granted promotion and consequential benefits. However, in the peculiar facts of this case representation, if any, filed by the petitioners is still pending for consideration before the District Programme Officer, the writ petition is disposed of with the direction to the respondent District Programme Officer Establishment, Saharsa to take appropriate decision on the pending representation and disposed of the representation if not already disposed of by reasoned and speaking order, expeditiously preferably within a maximum period of four months from the date of receipt / production of a copy of this order. 4.

With the aforesaid observation and direction, this writ petition is disposed of.
