JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-10-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Araria (Bairgachhi) P.S. Case No. 526 of 2001 registered under Section 420 of the Indian Penal Code.

The allegation of informant is that Hajari Lal Bhagat and Kamla Prasad Bhagat, cousin of the informant, sold the land of his share along with their mother in favour of the petitioners. Learned counsel appearing on behalf of the petitioners submits that petitioners are bona fide purchaser of the land, which is said to be in the share of the informant. Moreover, the dispute, as alleged in the complaint petition, is of civil in nature.

Case No. 526 of 2001, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
