The petitioner seeks bail in connection with K. Nagar P.S. Case No. 26/2017 dated 17.01.2017 instituted for the offences under Sections 341, 323, 324, 326, 307/34 and 302 of the Indian Penal Code.
Though there is a land dispute between the parties, but the petitioner is alleged to have given a spade blow leading to injuries on the mouth of the informant. Further allegation in the F.I.R. is that the petitioner along with others made attempt to put the mother of the informant on fire. The deceased was doused with kerosene oil and the petitioner is alleged to have lighted the match-stick leading to the burn injury and ultimately death of the mother of the informant.
Patna High Court Cr.Misc. No.51776 of 2017 (3) dt.27-11-2017 2/2 Learned counsel for the petitioner submits that the deceased died because of sitting by the side of fire during winter months. The entire allegation, it is alleged, is false and noting of the kind as has been alleged, ever happened.
Be that at it may, taking into account the fact that there is direct allegation against the petitioner, this Court is not inclined to grant bail to the petitioner for the present. The bail petition is rejected.
The petitioner, however, will be at liberty to approach this Court after a reasonable time.
