The petitioner seeks bail in C2 Case No. 359 of 2021, registered for the offence punishable punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018. 119.400 litres of Nepali liquor has been recovered from the bag of this petitioner and his associates. It is submitted that no recovery has been made from conscious possession of this petitioner and he has no concern with the seized liquor. Petitioner is in custody since 24.07.2021 having no criminal antecedent, as stated in para 3 of the petition. Investigation is complete.

Considering the period of custody coupled with the

No.53452 of 2021(2) dt.02-12-2021 2/2 fact that petitioner bears clean antecedent, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II-cum-Special Judge (Excise), Sitamarhi in connection with C2 Case No. 359 of 2021.
