14-09-2018 This application has been preferred seeking transfer of Maintenance Case No. 43M/2006 from the court of learned Principal Judge, Family Court, Patna to the court of learned Principal Judge, Family Court, Purnia. Learned counsel for the petitioner submits that for the reasons stated in the order dated 14.05.2012 passed in MJC No. 2164/2011, the learned coordinate Bench of this court had transferred the Matrimonial (Divorce) Case No. 26/2006 from the court of Principal Judge, Family Court, Patna to the court of Principal Judge, Family Court, Purnia.
It is submitted that earlier the maintenance case was filed at Patna when she was living with her husband in
Patna High Court MJC No.777 of 2014 (6) dt.14-09-2018 Mohalla - Mainpura, Danapur. However, presently because of the matrimonial discord between the parties she is living in her Maike at Purnia and the Divorce Case is also pending there, therefore this case is also required to be transferred at the same place.
No one appears on behalf of the opposite party even though the notice has been validly served upon him. In the aforesaid view of the matter, considering the facts and circumstances of the case particularly that this court finds about the ongoing matrimonial case at Purnia, it would be in the interest of justice that the maintenance case be also transferred to the same place as both the cases may be heard together.
This application is allowed.
Let the records of Maintenance Case No.
43(M)/2006 be transferred from the court of learned Principal Judge, Family Court, Patna to the court of learned Principal Judge, Family Court, Purnia within a period of 15 days from the date of receipt/production of a copy of this order.
