This application for grant of anticipatory bails arises out of Vaishali Police Station case No. 130 of 2016, disclosing offences under Sections 147,149,341,323,324,307,504 of the Indian Penal Code.

For the same occurrence alleged to have taken place on 01.06.2016, two First Information Reports have been lodged both on 06.06.2016, one registered at the instance of the informant of the present case, viz, Vaishali P. S. Case No. 130 of 2016 and the other lodged on the basis of fardbeyan of co-accused Ajmat Ali being Vaishali P. S. case No. 129 of 2016.

Learned counsel for the petitioner has submitted that both the parties have sustained injuries. He has further submitted that

title suit between the parties is pending, which has been mentioned in the First Information Report of Vaishali P. S. Case No. 129 of 2016.

Considering the genesis of the occurrence and the nature of accusation, this application is allowed. Let the petitioner above named in the event of his arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in Vaishali P.S. case No. 130 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
