Petitioners seek regular bail in a case registered for the offence punishable under Section 302, 201/34 of the Indian Penal Code.
As per the prosecution case, these petitioners committed the murder of father of informant due to past enmity and land dispute and both the petitioners earlier used to threat the deceased with dire consequences.
Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. The deceased was traceless since 29.04.2021 but the
Patna High Court CR. MISC. No.53455 of 2021(3) dt.21-01-2022 2/2 FIR was lodged on 03.05.2021when his dead body was found in a maize field. There is no eye witness of the occurrence and even the informant is not an eye witness of the occurrence and only on suspicion and previous enmity the petitioners have been made accused in this case. Petitioners claim clean antecedent and are in custody since 08.06.2021 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioners, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VI, Araria in connection with Raniganj PS case No.127/2021.
