JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 18-07-2018 The present writ petition has been filed for quashing the letter no. 369 dated 01.09.2007 by which the respondent no. 2 i.e. the Munger-Jamui Central Co-operative Bank Ltd., Munger had sent a demand notice for recovery of loan to the petitioner's office, however, the petitioner has never taken loan from the bank; and for connected reliefs.
2. At the very outset, learned counsel for the respondents takes a preliminary objection with regard to non-maintainability of the writ petition as the main relief has been sought against the Munger-Jamui Central Co-operative Bank Ltd. Reliance is placed on a judgment dated 03.11.2017 passed by this Bench in CWJC No. 6785 0f 2006 (Lalan
Patna High Court CWJC No.18678 of 2010 dt.18-07-2018 Prasad Choudhary vs. The Vaishali District Central Co-operative Bank Ltd., through its Managing Director, Vaishali at Hajipur).
3. Learned counsel for the petitioner is present.
4. The objection raised on behalf of the respondents is already covered by the judgment in Lalan Prasad Choudhary's case (supra) wherein the writ petition was held to be not maintainable against the Co-operative Society.
5. In the above view of the matter, the writ petition stands dismissed.
