JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-09-2018 Heard learned counsel appearing on behalf of the petitioners and counsel appearing on behalf of the State. The grievance of the petitioners is discrimination in the matter of grant of graduate trained scale. Counsel appearing on behalf of the petitioners with reference to Annexure- 2 submitted that many persons juniors to the petitioners were granted benefit of graduate trained scale, Headmaster and Senior pay-scale of Headmaster from early date whereas the petitioners were granted only pay-scale of headmaster from later date.

Learned counsel for the petitioners submits that

Patna High Court CWJC No.12011 of 2014(2) dt.19-09-2018 2/2 Petitioners have filed representation before the District Programme Officer (Establishment), Saharsa but District Programme Officer (Establishment), Saharsa has not disposed of the representation. Learned counsel for the petitioners further submitted that petitioners may be granted liberty to file fresh exhaustive representation before respondent District Programme Officer (Establishment), Saharsa.

In view of the above, the writ petition is disposed of with direction to the District Programme Officer (establishment) Saharasa to consider the representation, if filed by the petitioners along with copy of this order and pass appropriate order on the representation filed by the petitioners within a maximum period of four months from the date of filing of the representation by the petitioners and in the event petitioners' claim merits consideration similar treatment should be extended to the petitioners.

With the aforesaid, the writ petition stands disposed of.
