This is a petition for grant of anticipatory bail for offence under Sections 363, 366A and 34 of the Indian Penal Code.

The first information report was lodged on missing of Moti Kumari, minor daughter of the informant. The petitioners and others are suspected to have kidnapped her with intent to marry.

The victim girl in her statement under Section 164 of Criminal Procedure Code alleged hat she was kidnapped by coaccused, Meraj, only. She, further, stated that when got consciousness she found herself along with Meraj, who left her near the Police Station.

Considering the statement of the victim girl, specifically the fact that she has not stated anything against the petitioners, above named, they, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bonds of

Patna High Court Cr.Misc. No.53786 of 2016 (2) dt.14-12-2016 Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Bhagwanpur Hat P.S. Case No. 113 of 2016 to the satisfaction of the Additional Chief Judicial Magistrate, II, Siwan, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
