ANJANA MISHRA ORAL ORDER 06-11-2015 Heard learned counsel for the petitioner and learned counsel for the Vigilance.
The petitioner apprehends his arrest in connection with Spl. Case No. 11 of 2014 arising out of RC0232014A0021 registered for the offences punishable under Sections 120-B and 420 of the Indian Penal Code and Section 13(2) r/w 13(1) (d) of the Prevention of Corruption Act, 1988.
Learned Sr. counsel for the petitioner submits that during the course of investigation the case of the petitioner has not been substantiated. The final form is yet to be submitted in the case. He further undertakes that the petitioner shall cooperate with
Patna High Court Cr.Misc. No.9279 of 2015 (9) dt.06-11-2015 the investigation as and when required. He further submits that petitioner is a responsible Government Officer and he is not likely to abscond.
Considering the aforesaid submissions, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, CBI-III, Patna in connection with Spl. Case No. 11 of 2014 arising out of RC0232014A0021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
However, it is made clear that it shall be open for the Investigating Agency to move this court for modification of the order, if necessary.
