Petitioner is apprehending his arrest in connection with Raniganj P.S.Case no.26 of 2015 (G.R.No.331 of 2015) , registered for offences punishable under Section 420 of the Indian Penal Code.

Allegation as per the FIR is that the ATM card of the informant was changed inside the TM Room by some one and later on he came to know that twice the amount has been withdrawn from his account and thereafter he came to know that the amount has been transferred in the account of the petitioner and withdrawn also.

Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.46939 of 2019(2) dt.30-07-2019 2/2 that she is a lady and she has not withdrawn any amount and she has no knowledge of the transaction but in spite of the fact she is ready to return the amount if some reasonable time is given to her.

Heard learned A.P.P. also.

Having heard both sides and in view of the fact she is a lady and ready to return the amount, as such let the petitioner surrender by 8.8.2019 with a bank draft of Rs.15,000/- to be deposited in the name of the informant and on that she will be released on provisional bail in connection with Raniganj P.S.Case no.26 of 2015 (G.R.No.331/2015) for a period of two months and during that period she will deposit rest of the amount of Rs.15,000/- by bank draft in the name of the informant and once the total amount of Rs.30,000/- is deposited by the petitioner, her bail bond shall be confirmed otherwise the learned court below shall cancel the bail bond of the petitioner.

With the above direction, this application is disposed of.
