2. The petitioner seeks regular bail in connection with N.D.P.S. Case No. 12 of 2023, (arising out of Nathnagar P.S. Case No. 78 of 2023) registered for the offence punishable under Sections 21, 22 of the N.D.P.S. Act and Sections 17, 18 of Drugs & Cosmetics Act, 2003

3. As per prosecution case, 16 bottles of codeine cough syrup has been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner and he is in custody since 06.05.2023.

5. Learned APP has vehemently opposed the prayer for bail.

6. Considering the aforesaid fact and also nature of allegation, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District & Session Judge, Bhagalpur, in connection with N.D.P.S. Case No. 12 of 2023, (arising out of Nathnagar P.S. Case No. 78 of 2023).
