2. The petitioners are apprehending their arrest in connection with Rajoun P.S. Case No. 32 of 2024 dated 09.01.2024, for the offences punishable under Sections 341, 323, 307, 379 and 504 read with Section 34 of the Indian Penal Code
3. As per the allegation, the co-accused persons are alleged to have abused the informant and upon his protest, they assaulted the informant by means of lathi and khanti. When the brother of informant intervened, he was also assaulted. It is

4. Learned counsel for the petitioners submits that petitioners are innocent and they have falsely been implicated in the present case. Both the parties are agnates and next door neighbours and there is admitted land dispute between them. From perusal of FIR it appears that there is no specific allegation of any assault or overt act attributed against the petitioners, rather there is general and omnibus allegation against all the co-accused persons including the petitioners. The injured persons were medically examined and their injuries were found to be simple in nature.
5. Learned A.P.P. for the State opposes the prayer for pre-arrest bail of the petitioners.
6. Keeping in view of the aforesaid facts and circumstances of the case, this Court is inclined to extend them the privilege of anticipatory bail.
7. Accordingly, let the petitioners, above-named, in the event of their arrest or surrender before the learned trial Court within a period of four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) each with two

No.42732 of 2025(3) dt.18-07-2025 3/3 sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka / Successor Court, where the case is pending in connection with Rajoun P.S. Case No. 32 of 2024, subject to the conditions as laid down under Section 482(2) of the B.N.S.S., on further conditions: (i) One of the bailors should be close relative of the petitioners.
(ii) If the petitioners tamper with the evidence or threaten the witness, in that case, the prosecution will be at liberty to move for cancellation of bail.
(iii) In case, the petitioners repeat offence of similar nature after enlargement on bail, their bail bonds may be cancelled by the learned trial Court.
