This application has been filed for transfer of Matrimonial Case No. 81 of 2010 pending before the Principal Judge, Family Court, Chapra (Saran) to Principal Judge, Family Court, Patna.

An application has already been filed for restitution of conjugal right by the sole respondent (husband). The petitioner being lady, has different type of difficulties to attend case for restitution of conjugal right. It has been submitted by the petitioner that it will be very inconvenient for the petitioner to go to Chapra and attend the case on each and every date fixed, comparatively, the husband will not face much

Patna High Court MJC No.4219 of 2012 (9) dt.10-08-2015 2/2 inconvenience to attend the case at Patna, so much so, the counsel for the husband does not object to transfer the case from Chapra to Patna.

In such view of the matter, Matrimonial Case No. 81 of 2010 pending before the Principal Judge, Family Court, Chapra (Saran) is transferred to Principal Judge, Family Court, Patna. The court below is directed to expedite the trial and conclude the same within a period of six months from the date of receipt of the record from the court of Principal Judge, Family Court, Chapra (Saran). Parties are expected to co-operate in disposal of the case.
