Petitioner seeks bail in Kotwali P.S. Case No. 136 of 2017 for the offence punishable under Section 386/34 of the Indian Penal Code.

Allegation against the accused is of running away with Rs. 17,000/- cash and one ring costing Rs. 5 Crores. It has been submitted by the learned counsel for the petitioner that the name of the petitioner transpired from the confessional statement made by Md. Ali except that confessional statement, nothing incriminating material had been recovered from the conscious possession of the petitioner. It has been further submitted that similarly placed co-accused persons have already been granted bail vide order dated 02.08.2017 in

Patna High Court Cr.Misc. No.49002 of 2017(2) dt.17-10-2017 2/2 Criminal Miscellaneous No. 28608 of 2017 and 19.08.2017 in Criminal Miscellaneous No. 38810 of 2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Kotwali P.S. Case No. 136 of 2017.
