2. This is the second attempt of the petitioner for grant of regular bail in connection with Benipatti P.S. Case No. 252 of 2023 registered for the offence under Sections 25(1-b)a, 26, 35 of the Arms Act.

3. As per the prosecution case, the recovery is one country made pistol from the petitioner.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and has falsely been implicated in the present case. He also submits that the petitioner is in custody since 2.11.2023.

5. Considering the aforesaid facts and the period of

Patna High Court CR. MISC. No.49516 of 2024(2) dt.30-08-2024 2/2 custody, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Benipatti, Madhubani in connection with Benipatti P.S. Case No. 252 of 2023.

7. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Benipatti Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Vikas/- U
