2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 140 (1), 140(3), 3(5) of the BNS, 2023.

3. The case of the prosecution, in brief, is that son of the informant namely, Shublal Ram (deceased) has gone to meet Lalita Devi (petitioner no.1). It is also alleged that the deceased was having an illicit relationship with the said Lalita Devi. Thereafter, the son of the informant went missing and his dead body was recovered after 12 days. The informant suspects that the petitioners are responsible for killing her son.

4. Learned counsel for the petitioners submits that the

Patna High Court CR. MISC. No.42172 of 2025(3) dt.20-08-2025 2/2 petitioners are innocent and have falsely been implicated in connection with the present case. It is contended that their implication rests merely on suspicion, without any substantive or cogent material to connect them with the alleged murder of the informant's son. It is further submitted that during the course of investigation, the only material that has surfaced is that the deceased had made a telephonic call to Lalita Devi. Moreover, the petitioners are languishing in judicial custody since 19.01.2025 having no criminal antecedent.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Pipra P.S. Case No. 19 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran.
