This application is for grant of regular bail in connection with Kursela P.s.caase No.74 of 2018 for the offences under Sections -341, 342, 307, 302/34 of the Indian Penal Code. Allegation against the petitioner and other accused persons is that he came armed with three nut and the petitioner fired on Mangal Mandal by three nut, causing injury to him and later on Mangal Mandal died.
Submission of the learned counsel for the petitioner is that in para 26 of the case diary, the other witness has not named this petitioner and he has been falsely implicated in this case. He is in custody since 16.5.2018.
Heard learned A.P.P., who has opposed the prayer for bail on the ground that the informant claims himself to be eye
Patna High Court Cr.Misc. No.62580 of 2018 (3) dt.05-11-2018 2/2 witness of the occurrence and the postmortem report also supports the prosecution case.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner.
With the aforesaid observation, this application is dismissed.
