The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 376, 324, 506 of the Indian Penal Code.

As per FIR, the allegation against the petitioner is that he committed rape with the informant on false pretext of marriage. It is further alleged that the petitioner had also taken total Rs. 1,30,700/- from the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The victim is a matured mind lady aged about 26 years and as per her statement

Patna High Court CR. MISC. No.43680 of 2023(2) dt.21-07-2023 2/3 recorded under Section 164 of the Cr.P.C., which is annexed with Annexure-2, wherein she stated that she was in love with this petitioner and there was consensual relation between both of them. It is further submitted that the petitioner is languishing in judicial custody since 21.05.2023.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail after framing of charge, if charge has not been framed as yet. The above named petitioner is directed to be released on bail in connection with Sanokhar P.S. Case No. 71 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,-Ist Class, Bhagalpur.
