The petitioner apprehends his arrest in Dalsingsarai P.S. Case No. 217 of 2015 registered for the offences punishable under Sections 304(B) and 34 of the Indian Penal Code. The informant alleged that his daughter was married to Vinay Ram, the petitioner about two years ago. After six months of marriage Vinay Ram and his family members began to torture his daughter to give two Kattha of land and one motorcycle. The daughter of the informant always informed about torture given to her. On 01.06.2015 the informant got information on his mobile that his daughter was brutally assaulted and she was taken to hospital.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.58263 of 2015 (11) dt.22-09-2016 2/2 petitioner never tortured his wife. His wife was suffering from diarrhoea and she died but from perusal of the viscera report it appears that the deceased died due to consumption of Phosphorous (Thimet). The deceased died within three years of her marriage and there is specific allegation against the petitioner that he was torturing his wife.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
