====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 28-11-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Sessions Trial No. 487 of 2017 arising out of Rajeev Nagar P.S. Case No. 25 of 2017/ G.R. No. 777 of 2017 for the offences under Sections 302 and 201 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, earlier on two occasions, the prayer for bail of this petitioner had been rejected by this Court vide order dated 21.06.2018 and 07.03.2018 passed in Cr. Misc. No. 19725 of 2018 and Cr.

Patna High Court Cr.Misc. No.61973 of 2018(3) dt.28-11-2018 2/2 Misc. No. 57822 of 2017, respectively. On the second occasion, this Court vide order dated 07.03.2018 while rejecting the prayer for bail of this petitioner had directed the trial court to expedite the trial of the case and conclude the same within a period of six months from the date of order. It is further submitted that despite direction of this Court, the trial has not been concluded as yet by the trial Court and the same is not likely to be concluded in near future, which is evident from annexure-3. The petitioner is rotting in custody for more than one and half year. Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-V, Patna in connection with Sessions Trial No. 487 of 2017 arising out of Rajeev Nagar P.S.
