This application is for grant of regular bail in connection with Raniganj P.S.Case No.323 of 2016 for the offences punishable under Sections 147, 148, 149, 342, 302, 307 and 120B of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is of assaulting the deceased by arrows and there is also allegation against the several other accused persons of assaulting.

Submission of the learned counsel for the petitioner is that though there is allegation of assault by arrow against the petitioner and there is also allegation of assault by several other accused persons by arrows and other arms whereas there are only

Patna High Court Cr.Misc. No.49648 of 2017 (2) dt.09-11-2017 2/2 two injuries on the person of the deceased- one on the neck and another on the leg. The petitioner is in custody for about five months.

Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail. Having heard both sides and in view of facts and circumstances, at this stage, I am not inclined to grant bail to the petitioner but once the charge is framed against the petitioner, the learned trial court shall release the petitioner in connection with Raniganj P.S.Case no.323 of 2016, to his own satisfaction with condition that he shall co-operate in disposal of the trial. With the aforesaid observation, this application is disposed of.
