Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 25(1B)a, 26 of the Arms Act. It is alleged that the miscreants have committed loot on Kesho Balu Ghat and resorted to fire, causing injury to one person. On spot the informant found injured in unconscious condition. From the possession of said injured 6 live cartridges and one empty cartridge were recovered. One loaded pistol was also recovered from the nearby the place. Subsequently, injured was residing with one Vikash Kumar Singh. The name of the petitioner sprang up during investigation.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.53465 of 2015 (2) dt.24-11-2015 petitioner that admittedly there was no recovery from the petitioner and only on suspicion in the initial case being Barun P.S. Case No. 205 of 2014 and Barun P.S. Case No. 213 of 2014 the petitioner was made accused, in which petitioner is on bail.
The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Barun P.S. Case No. 214 of 2014, pending in the court of learned Chief Judicial Magistrate, Aurangabad.
With this observation this application is disposed of.
