JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-12-2015 The petitioners being the parents of the husband of the informant have renewed their prayer for anticipatory bail in case registered for the offences punishable under Section 498A of the IPC and Section 3/4 of the Dowry Prohibition Act. The basic accusation is of torture for non-fulfillment of the dowry demand.
It is submitted by learned counsel for the petitioners that earlier the petitioners preferred their anticipatory bail application vide Cr. Misc. No. 23090 of 2014 which stood dismissed for non-compliance of peremptory order dated 05.12.2014 and thereafter restoration application vide Cr. Misc. No. 24519 of 2015 was filed which also stood dismissed due to non-prosecution.
In the circumstances, this Court is not inclined to
Patna High Court Cr.Misc. No.57117 of 2015 (2) dt.18-12-2015 2/2 entertain the present application for anticipatory bail. However, considering the nature of accusation, since the thrust of accusation is against the husband of the informant, it is a case for consideration of prayer for regular bail. Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Madhepura Mahila P.S. Case No. 13 of 2013 pending in the court of learned SDJM, Madhepura. It is expected from the learned court below to consider the prayer for regular bail preferably on the same day. Accordingly, the application is disposed of.
