The petitioner seeks bail in Vishnupad P.S. Case No. 46/2019, instituted for offence under Section(s) 379 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner has no criminal antecedent. Mere suspicion has been raised against him.

It is alleged in the written report that on the date of occurrence at night informant parked his motorcycle in front of his door. He awoke at 2-3 O'clock and found his motorcycle was missing. It is alleged that on the basis of CCTV footage, petitioner and one Subham Barnwal were interrogated who

Patna High Court CR. MISC. No.41583 of 2019(2) dt.12-07-2019 2/2 disclosed about Ankit Kumar, who had taken the motorcycle for sale. Thereafter, petitioner and co-accused Subham Kumar were produced before the police.

Petitioner is in custody since 09.03.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Vishnupad P.S. Case No. 46/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
