The petitioner seeks bail in connection with Mansi P.S. Case No. 40 of 2018 instituted for the offence under Section(s) 147, 149, 341, 323, 308, 504 and 506 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that prior to lodging of this case this petitioner had filed a criminal case against the informant and other family members on 28.3.2017 vide Mansi P.S. case no 69 of 2017. In the instant case, there is allegation against this petitioner of assaulting the brother of the informant with iron rod on his head.
The injury report of the injured has been annexed as
Patna High Court Cr.Misc. No.61704 of 2018(3) dt.26-11-2018 2/2 Annexure 4 to the bail petition, wherein, the doctor has found only one injury on the person of the injured of size 3" x 2" and after City Scan the doctor has opined the injury to be grievous in nature.
Petitioner is in custody since 21.8.2018 having no criminal antecedent.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Mansi P.S. Case No. 40 of 2018, subject to the condition that both the bailers shall be the close relative of the petitioner.
