Petitioner is an accused in a case registered for the offence punishable under Sections 304B, 302, 498A, 201 and 120B of the Indian Penal Code on the allegation that the petitioner and other accused persons subjected the informant's sister to cruelty for fetching dowry and finally they killed her and disposed of the dead body secretly.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case as he is nephew (Bhagina) of the uncle of the husband of the deceased, as such, being a distant relative, has no concerned with her affairs. Petitioner has no criminal antecedent and is in custody since 15.3.2019 though the allegation is general and omnibus against him. Similarly situated co-accused Kailash Das and

In view of the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad Hulasganj Police Station Case No. 115 of 2017 on the condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
