This application, for grant of regular bail, arises out of N.T.P.C. Police Station Case No. 07 of 2020, disclosing offences under Section 420/465/468 of the Indian Penal Code. The allegation, as per the First Information Report is that at the time of appointment of the petitioner, as Switch Operator Category-II, he had produced the certificates which was subsequently found false and fabricated.

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he was initially appointed on contract basis in the year 2014 and at the time of his appointment, all the testimonials and

Learned counsel next submits that service of the petitioner was regularised in the year 2015 and that point of time also, his testimonials and certificates were verified and he continued to serve as Switch Operator Category-II till he was terminated from service on 12.09.2019 on the ground that certificate produced by the petitioner was false and fabricated. Learned counsel next submits that the petitioner is in custody since 13.04.2020.

Having regard to the submissions made by the parties and taking into consideration the materials on record and the fact that petitioner is in custody since 13.04.2020, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, Mahesh Prasad Singh, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with N.T.P.C. Police Station Case No. 07 of 2020.
