The petitioner apprehends his arrest in Dhanha P.S. Case No. 8 of 2016 registered for the offences punishable under Sections 366(A) and 34 of the Indian Penal Code. The informant alleged that his daughter had gone to attend call of nature but she did not return. During course of search the informant came to know that his daughter was talking with Chhotu Chaudhary who had come to the house of his brotherin-law Guddu Chaudhary, the petitioner. Learned counsel for the petitioner submits that Chhotu Chaudhary happens to be brother-in-law of the petitioner and that is why the petitioner has falsely been implicated in the case. The victim disclosed that she voluntarily left her house and went along
Patna High Court Cr.Misc. No.49884 of 2016 (2) dt.09-01-2017 2/2 with Chhotu Chaudhary. The victim solemnized marriage with Chhotu Chaudhary.
Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bagaha, West Champaran in Dhanha P.S. Case No. 8 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
