JUSTICE MADHURESH PRASAD ORAL ORDER 12-01-2018 Heard learned counsel for the petitioner and the State. Petitioner is an accused in a case registered for offence under section 395 of the IPC on the allegation that he along with others looted motorcycle, wrist watch and mobile phone of the informant.

The petitioner disputes the recovery as the seizure list shows that the EMI number of the mobile phone set seized from him differs from the EMI number of the set mentioned to be snatched in the FIR. Petitioners name has been taken in the confession of co-accused Kalendra yadav. Petitioner is in custody since 23.6.2017.

Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Masaurhi in Dhanarua Police Station Case No. 237 of 2017,GR No. 611 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how

(b) The Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
