JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 24-02-2021 Perused the report dated 3.2.2021 of the Additional District & Sessions Judge-II-cum- Special Judge Excise, Kaimur at Bhabhua whereby he has submitted that after examination of the Investigating Officer the prosecution evidence has been closed and the matter is now listed for statement of the accused under Section 313 Cr. P.C. on 12.2.2021.

The present application is disposed of with direction to the trial Court to conclude the trial within a further period of two months from the date of receipt/production of a copy of this order positively failing which the Court below shall release the petitioner on appropriate terms and conditions and submit failure report to the Registrar (Vigilance) of this Court for appropriate action.
