====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-08-2024 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 324, 379, 307, 504, 506/34 of the Indian Penal Code.

3. As per the prosecution case, all the F.I.R. named accused persons including these petitioners having lathi, danda, iron rod and knife, assaulted informant and his nephew.

4. Learned counsel for the petitioners submits that specific accusation of assault is against co-accused Umesh

Patna High Court CR. MISC. No.46630 of 2024(2) dt.13-08-2024 2/2 Sahni who is alleged to have assaulted Sonu Kumar from butt of pistol and caused injury on his head and body. He next submits that the injuries allegedly caused by these petitioners are simple in nature. Allegation of assault against these petitioners is general and omnibus. Petitioners have got clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Danapur in connection with Maner P. S. Case No. 33 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
