M.Dayal, APP for the State.

Petitioner being father of the main accused has prayed for grant of anticipatory bail in Phulparas P.S. Case No. 111 of 2011 registered under sections 366 and 366A/34 of the Indian Penal Code, which was lodged in the year 2011 naming the petitioner and few others.

The victim is still traceless. From the order-sheet of the learned Sessions Judge, it appears that the processes were issued against the petitioner as he evaded the process of the Court for a long time. It has been submitted that there is no direct implication of the petitioner in the crime. According to the F.I.R., it is the son who has abducted/kidnapped the daughter of the informant.

Patna High Court Cr.Misc. No.48781 of 2016 (2) dt.16-12-2016 2/2 Learned APP opposed the prayer submitting that there is inordinate delay in approaching the Court. The investigating authority had to take steps under sections 82 and 83 of the Cr.P.C.

Considering the above, in my view, the petitioner does not deserve the privilege of anticipatory bail. Prayer is rejected.
